By accessing or using nadakharma.com (the "Site") or placing an order through the store, you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy & Shipping Policy.

If you do not agree to these terms, please do not use the Site or make a purchase.

The Site is operated by Nada Kharma, a sole artist selling original artworks, fine-art prints, and commission portraits to customers in the United States.

We reserve the right to modify or discontinue any product, service, or feature at any time without notice, and we will not be liable to you or any third party for doing so.

You may be required to create an account to place an order or track your purchases. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account.

Notify us immediately at hello@nadakharma.com if you suspect unauthorized use of your account. We are not liable for any loss that results from your failure to keep your login information secure.

You must be at least 18 years old to create an account and make a purchase. By registering, you confirm that you meet this requirement.

All prices are listed in US Dollars (USD) and are subject to change without notice. Applicable taxes and shipping costs are calculated and displayed at checkout before you confirm your order.

An order confirmation email means we have received your order — it is not a guarantee of fulfillment. In the unlikely event that an item is no longer available or we are unable to fulfill your order, we will notify you promptly and issue a full refund.

Payment is processed securely through Stripe. We accept major credit and debit cards. By submitting payment information, you represent that you are authorized to use the payment method provided.

Because every piece is a work of original art — either a one-of-a-kind original or a limited fine-art print produced to order — all sales are final. We do not accept returns, exchanges, or issue refunds once an order has been placed and payment processed.

Please review artwork dimensions, edition details, and any questions about color or texture carefully before purchasing. If you have questions before buying, email hello@nadakharma.com.

Damaged or lost shipments are handled under our Shipping Policy. Carrier damage is the only circumstance in which a replacement or store credit may be offered, subject to photographic evidence provided within 48 hours of delivery.

All artwork, images, text, and other content on this Site are the intellectual property of Nada Kharma and are protected by copyright law. Purchasing a physical print or original artwork transfers ownership of the physical object only.

The purchase does not transfer any copyright, reproduction rights, or other intellectual property rights. You may not:

• Reproduce, scan, or photograph artwork for commercial purposes
• Create derivative works or sell reproductions of purchased pieces
• Use artwork in advertising, merchandise, or media without written permission

Personal, non-commercial sharing (e.g., posting a photo of your new artwork on social media with credit to @nadakharma) is always welcome and appreciated.

Commission portrait orders are subject to additional terms:

• A non-refundable deposit (typically 50% of the total) is required to begin work. The remaining balance is due before shipment.
• Once painting has begun, the deposit is non-refundable under any circumstances.
• If you cancel before work starts, contact us immediately — we'll do our best to accommodate, but the deposit may still be retained if materials have been ordered.
• You are responsible for supplying high-quality reference photos. Nada reserves the right to decline a commission if the provided references are insufficient.
• Minor artistic interpretations are part of the creative process. One round of reasonable revisions is included; additional revisions may incur extra fees.

Timelines are estimates. Factors outside Nada's control (illness, supply delays) may extend the timeline. We will communicate any significant delays proactively.

You agree not to use this Site to:

• Violate any applicable law or regulation
• Submit false or misleading information during checkout or account creation
• Attempt to gain unauthorized access to any part of the Site or its underlying systems
• Scrape, crawl, or harvest content or data from the Site without express written permission
• Transmit malware, spam, or any disruptive or harmful code
• Misrepresent your identity or affiliation for the purpose of obtaining artwork under false pretenses

We reserve the right to terminate your account and refuse service for any violation of these terms.

The Site and its content are provided on an as is " and " as available " basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. Color representation of artwork on screen may vary from the physical piece due to monitor calibration differences.

To the fullest extent permitted by law, Nada Kharma shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or any product purchased through it, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from or related to a purchase shall not exceed the amount you paid for the specific order giving rise to the claim.

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in New York.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

We may update these Terms of Service at any time. When we do, we‘ll update the "Last updated" date at the top of this page. Continued use of the Site after changes are posted constitutes your acceptance of the revised terms.

For significant changes, we may also notify registered users by email.
